NeckUp（亦称“仰止”“本应用”）是一款帮助用户进行专注计时、坐姿提醒和颈部活动训练的 iOS 应用。本隐私政策用于说明我们如何收集、使用、存储、共享和保护你的信息。

1. 适用范围

本政策适用于你使用 NeckUp iOS 应用及相关功能过程中发生的信息处理活动，包括番茄钟专注计时、坐姿检测、颈部活动游戏、专注记录和订阅服务。

2. 我们可能处理的信息

3. 当前不会主动收集的信息

基于当前已知版本，本应用不提供独立用户账号系统，通常也不会主动收集你的身份证号、通讯录、短信、照片库内容、精准定位或聊天内容。

4. 我们如何使用这些信息

提供番茄钟专注计时、休息提醒与通知功能；
识别 AirPods 头部运动传感器数据，用于坐姿分析和游戏交互；
生成热力图、历史记录、专注统计与坐姿数据；
验证和恢复 Apple 应用内购订阅状态；
处理反馈、故障排查和安全维护；
在未来版本中，如启用 iCloud 云同步，用于实现用户在 Apple 生态内的跨设备数据同步；
在未来版本中，如接入统计 SDK，用于分析功能使用情况、应用稳定性和崩溃问题。

5. 数据存储与同步

根据当前产品设计，你的核心使用数据主要存储在设备本地。当前版本如未正式启用 iCloud 云同步，则专注记录、坐姿统计等数据原则上不会同步到开发者自建服务器。

未来如接入 iCloud 云同步，相关数据可能通过 Apple 提供的云服务在你的 Apple 设备之间同步。届时我们会根据实际实现情况补充说明同步的数据范围、触发条件和管理方式。

6. 权限与系统能力

运动与健身权限：用于读取与头部运动相关的传感器数据；
通知权限：用于番茄钟提醒、休息提醒或重要状态提示；
蓝牙或音频相关能力：用于识别 AirPods 连接状态并启用相关功能；
未来如接入 iCloud：可能需要使用与你 Apple 账户相关的系统云同步能力。

若你拒绝相关权限，部分功能可能无法正常使用，但不影响其他基础功能的可用性。

7. 与 Apple 订阅服务的关系

本应用通过 Apple StoreKit 提供订阅服务。购买、扣款、自动续费、取消续费和退款等流程由 Apple 根据其规则处理。我们不会直接保存你的银行卡号、Apple ID 密码等完整支付信息。

8. 信息共享、披露与第三方

除以下情形外，我们不会出售你的个人信息，也不会向无关第三方共享你的信息：

获得你的明确同意；
为实现 Apple 内购、iCloud 同步或系统级能力调用，由 Apple 或相关系统服务在其职责范围内处理信息；
未来如接入统计 SDK，SDK 服务商可能在其提供的技术服务范围内处理必要的设备、使用或崩溃数据；

9. 未成年人保护

本应用面向未成年人开放使用。若你未满 18 周岁，建议在监护人同意和指导下阅读本政策并使用本应用。监护人应帮助未成年人正确理解相关功能、风险与信息处理方式。

我们鼓励未成年人在监护人陪同下开启涉及传感器、提醒和训练的功能；
如果监护人认为未成年人向我们提供了不适当的信息，可通过 [email protected] 与我们联系；
如发现未成年人信息处理缺乏合法基础，我们会依法采取删除、更正或限制处理等措施。

10. 你的权利

知悉我们如何处理你的信息；
访问、更正或删除你主动提供给我们的信息；
撤回已授予的系统权限；
就隐私问题向我们提出咨询、投诉或建议；
如未来启用云同步或账号相关能力，可进一步要求说明数据同步与删除路径。

11. 数据安全

我们会采取合理的技术和管理措施保护你的信息，尽量防止未经授权的访问、披露、篡改或丢失。但任何互联网传输或电子存储方式都无法保证绝对安全。

12. 政策更新

如本隐私政策发生重大变化，我们可能通过应用内页面、官网或其他合理方式通知你。更新后的版本自页面标注的生效日期起生效。

English Version: Privacy Policy

NeckUp (also referred to as “YangZhi”, “the App”, “we”, or “us”) is an iOS application designed to help users with focus sessions, posture reminders, and neck exercise activities. This Privacy Policy explains how we collect, use, store, share, and protect information in connection with your use of the App.

1. Scope

This Policy applies to information processing activities arising from your use of the NeckUp iOS application and its related features, including Pomodoro timing, posture detection, neck exercise gameplay, focus records, and subscription services.

2. Information We May Process

3. Information We Do Not Intentionally Collect at Present

Based on the current known version, the App does not provide a standalone account system and generally does not intentionally collect your government ID number, contacts, SMS content, photo library content, precise location, or chat content.

4. How We Use Information

to provide Pomodoro timing, break reminders, and notifications;
to detect AirPods head motion data for posture analysis and gameplay control;
to generate heatmaps, focus history, focus statistics, and posture-related metrics;
to verify and restore Apple in-app subscription status;
to respond to feedback, troubleshoot issues, and maintain security;
if iCloud sync is enabled in the future, to support cross-device synchronization within Apple services; and
if an analytics SDK is added in the future, to measure feature usage, app stability, and crash behavior.

5. Storage and Synchronization

Under the current product design, core usage data is primarily stored locally on your device. If iCloud sync has not yet been formally enabled in the current version, focus records, posture statistics, and similar data are generally not synchronized to developer-controlled backend servers.

If iCloud sync is introduced in the future, relevant data may be synchronized across your Apple devices through Apple-provided cloud services. We will then update this Policy to describe the scope of synchronized data, triggering conditions, and management options.

6. Permissions and System Capabilities

Motion & Fitness: to read motion-related sensor data;
Notifications: to send Pomodoro reminders, break alerts, and important status notifications;
Bluetooth or audio-related capabilities: to recognize AirPods connection status and enable related features; and
future iCloud capabilities: to support Apple account-based system cloud synchronization where applicable.

If you deny these permissions, some features may not function properly, while other basic features may remain available.

7. Apple Subscriptions and In-App Purchases

The App offers subscriptions through Apple StoreKit. Payment, billing, renewal, cancellation, and refunds are handled by Apple according to Apple’s rules. We do not directly store your payment card number, Apple ID password, or equivalent payment credentials.

8. Sharing, Disclosure, and Third Parties

We do not sell your personal information. We do not share your information with unrelated third parties except in the following circumstances:

with your explicit consent;
where Apple or relevant system services process information within their own roles to enable in-app purchases, iCloud sync, or system-level features;
if an analytics SDK is introduced in the future, where the SDK provider processes necessary device, usage, or crash data within the scope of its technical services;
where disclosure is required by applicable law, regulation, court order, or lawful government request; or
where disclosure is reasonably necessary to protect the rights, property, or safety of the developer, users, or the public as permitted by law.

9. Children and Minors

The App may be used by minors. If you are under the age of 18, you should review this Policy and use the App with the consent and guidance of a parent or legal guardian. Guardians should help minors understand the App’s features, risks, and information practices.

We encourage minors to enable sensor-based, reminder-based, and exercise-related features only with guardian guidance;
if a guardian believes a minor has provided inappropriate information to us, the guardian may contact us at [email protected]; and
if we determine that a minor’s information has been processed without a valid legal basis, we will take steps required by applicable law, including deletion, correction, or restriction of processing where appropriate.

10. Your Rights

to know how your information is processed;
to request access to, correction of, or deletion of information you voluntarily provide;
to withdraw permissions previously granted;
to contact us with privacy questions, complaints, or suggestions; and
if cloud syncing or account-related features are added in the future, to request more information about synchronization and deletion methods.

11. Security

We use reasonable technical and organizational measures to protect your information against unauthorized access, disclosure, alteration, or loss. However, no method of transmission or storage can be guaranteed to be absolutely secure.

12. Policy Updates

We may update this Privacy Policy from time to time. If material changes are made, we may notify you through the App, a website, or other reasonable means. The updated version becomes effective on the date indicated on this page.

2. 使用条件

你应当以合法、正当的方式使用本应用，不得实施以下行为：

反向工程、反编译、破解或干扰本应用正常运行；
利用本应用从事违法活动；
规避订阅或付费机制；
以可能损害开发者、Apple 或其他用户权益的方式使用本应用。

3. 健康与训练免责声明

本应用中的坐姿提醒、颈部活动训练和相关统计，仅用于一般性的专注辅助、健康习惯管理和轻量训练参考，不构成医疗建议、诊断、治疗意见或专业康复方案。

如果你存在颈椎、神经、平衡系统或其他健康问题，或在使用过程中感到疼痛、不适、眩晕，请立即停止使用并咨询合格医生或专业人士。

4. 未成年人使用说明

未成年人可以使用本应用，但建议在监护人指导下使用。本应用中的提醒、训练和统计功能不应替代监护人或专业人士的判断。

监护人应协助未成年人理解权限授权、提醒强度与训练边界；
若监护人不同意本协议或隐私政策内容，未成年人应停止使用本应用；
对于未成年人因不当使用训练功能导致的不适，建议立即停止使用并寻求专业建议。

5. 权限、兼容性与未来功能

部分功能依赖特定硬件、系统版本或权限，例如 AirPods 头部运动传感器、运动与健身权限、通知权限等。未来如接入 iCloud 云同步或统计 SDK，相关功能和条款也可能相应调整。

6. 订阅与付款

付费功能通过 Apple 应用内购买机制提供；
价格、自动续费规则、付款方式和退款机制以 Apple 展示页面及 Apple 规则为准；
订阅管理、取消续费和退款申请通常需要通过你的 Apple 账户完成。

7. 知识产权

本应用及其软件、界面设计、图形、文本和相关内容的知识产权，除依法属于第三方或用户内容外，均归开发者或权利人所有。未经书面许可，你不得擅自复制、传播、修改、出租、出售或进行其他超出授权范围的使用。

8. 免责声明与责任限制

本应用按“现状”提供；
我们不保证服务持续不中断、毫无错误，或完全适配所有设备；
因设备故障、系统限制、网络异常、Apple 服务异常、第三方系统变更、不可抗力等造成的影响，我们将在法律允许范围内承担相应责任；
你依据本应用中的训练建议、提醒或统计结果作出的个人决定，应由你自行判断并承担相应风险。

9. 协议变更

我们有权根据业务变化、法律要求或产品迭代对本协议进行更新。更新后继续使用本应用，视为你接受更新后的协议。

10. 适用法律与争议解决

本协议的订立、生效、解释与争议解决，适用中华人民共和国上海市相关法律法规及司法管辖要求。因本协议引起的争议，双方应先友好协商；协商不成的，提交有管辖权的相关机构处理。

Welcome to NeckUp. These Terms of Use form an agreement between you and the developer, Peng Tianhao, regarding the download, installation, and use of the App and related services.

1. Services Provided

The App currently provides Pomodoro focus timing, AirPods-based posture detection and reminders, a neck exercise game controlled by head movement, focus heatmaps and posture statistics, and subscription-based features delivered through Apple in-app purchases.

2. Conditions of Use

You agree to use the App lawfully and properly. You must not:

reverse engineer, decompile, crack, or interfere with the normal operation of the App;
use the App for unlawful purposes;
circumvent subscription or payment mechanisms; or
use the App in a way that may harm the developer, Apple, or other users.

3. Health Disclaimer

Posture reminders, neck exercise activities, and related metrics in the App are provided only for general focus assistance, habit support, and light wellness reference. They do not constitute medical advice, diagnosis, treatment, or professional rehabilitation guidance.

If you have neck, neurological, balance, or other health conditions, or if you experience pain, discomfort, or dizziness while using the App, stop using it immediately and consult a qualified medical professional.

4. Use by Minors

Minors may use the App, but guardian guidance is recommended. The reminder, training, and statistical features of the App should not replace the judgment of parents, guardians, or medical professionals.

Guardians should help minors understand permissions, reminder intensity, and training boundaries;
if a guardian does not agree to these Terms or the Privacy Policy, the minor should stop using the App; and
if a minor feels discomfort while using exercise-related features, use should stop immediately and professional advice should be sought.

5. Permissions, Compatibility, and Future Features

Some features depend on specific hardware, OS versions, and permissions, such as AirPods head motion sensors, Motion & Fitness permissions, and notification permissions. If iCloud sync or an analytics SDK is introduced in the future, related features and legal terms may also be updated.

6. Subscriptions and Payment

Paid features are offered through Apple’s in-app purchase mechanism;
pricing, auto-renewal rules, payment methods, and refund handling are governed by Apple’s storefront and policies; and
subscription management, cancellation, and refund requests are generally handled through your Apple account.

7. Intellectual Property

Except as otherwise required by law or owned by third parties, all rights, title, and interest in and to the App, including its software, interface design, graphics, text, and related content, belong to the developer or the applicable rights holder. You may not copy, distribute, modify, rent, sell, or otherwise use such content beyond the permitted scope without prior written permission.

8. Disclaimer and Limitation of Liability

the App is provided on an “as is” basis;
we do not guarantee uninterrupted service, error-free operation, or compatibility with every device;
impacts caused by device failures, system limitations, network issues, Apple service interruptions, third-party system changes, or force majeure will be handled within the scope permitted by law; and
you are responsible for your own decisions made in reliance on the App’s reminders, exercise content, or statistics.

9. Changes to These Terms

We may update these Terms based on business changes, legal requirements, or product iterations. Your continued use of the App after updated Terms become effective constitutes acceptance of the updated Terms.

10. Governing Law and Dispute Resolution

These Terms are governed by the applicable laws and dispute resolution requirements of Shanghai, People’s Republic of China. Any dispute arising from or relating to these Terms should first be resolved through friendly consultation. If no resolution is reached, the dispute shall be submitted to the competent authority with jurisdiction.
